वैसे यह काम काफी हिम्मत का है। ऐसे समय में उनको अपने साथी का साथ देना चाहिए मगर वो ऐसा नहीं करते, बल्कि उलटे आपका वो मजाक ही नहीं उड़ाते बल्कि आपको देखकर कन्नी काटते है। ऐसे में आपको किसी मार्गदर्शक और आपके लड़ाई में साथ देने वाले किसी रास्ता दिखाने वाले की जरुरत होती है।

अगर आप वर्कमैन की परिभाषा में आते हैं तो आपके कंपनी मालिक के साथ कोई भी औधोगिक वाद-विवाद होता हैं तो इसके निपटारेा के लिए लेबर कोर्ट का गठन किया गया है।
हमारे देश में लेबर कोर्ट की स्थापना औधोगिक विवाद अधिनियम 1947 (industrial dispute act, 1947) के तहत किया गया हैं। एक तरह से देखें तो लेबर कोर्ट का काम कंपनी और कर्मचारी के बीच के वाद विवाद को निपटना और के अनुसार उचित निर्णय देना हैं। लेबर कोर्ट industrial dispute act, 1947 के तहत कर्मचारी के गैर क़ानूनी टर्मिनेशन पर नौकरी पर बहाली से लेकर पीछे का पूर्ण सैलरी (Full Back Wages) देने का अधिकार होता हैं। इसके भी आलावा अलग-अलग एक्ट के तहत अलग निर्णय लेने का अधिकार है।

लेबर कोर्ट में केस करने का तरीका
Labour Commissioner आपकी शिकायत पर कैसे कार्रवाई करेगा?
आपके Complaint देने के बाद Assistant Labour Commissioner आपकी शिकायत पर आपके कम्पनी प्रबंधन को 30 दिन के अंदर उपस्थित होने के लिए Notice भेजेगा। जिसका एक Copy आपको भी प्राप्त होगा। जिसमे उपस्थित होना का Date और Time और Place का विवरण मौजूद होगा। उस दिन आप अपने पूरे Document लेकर उपस्थित हों।

इस दौरान Labour Commissioner दोनों पक्षों को सुनने के बाद आपके और आपके कम्पनी के बीच सुलह करने की कोशिश करता है। नियम के मुताबिक अगर 45 दिन में सुलह या समझौता नहीं हुआ तो वो खुद ही सम्बंधित लेबर कोर्ट में आपके केस को रेफर कर देंगे। इस तरह से आपका केस लेबर कोर्ट में चला जायेगा। जिसके बाद आपकी आगे की सुनवाई लेबर कोर्ट में होगी।

Q.1- क्या हम डायरेक्ट लेबर कोर्ट में एप्लीकेशन लगा सकते हैं?
Ans-नहीं, हमें पहले समबंधित लेबर कमिश्नर ऑफिस में शिकायत लगाना होता है। जिसके बाद अगर मामला का समाधान नहीं होता है तो लेबर कमिश्नर के द्वारा मामले को लेबर कोर्ट में रेफर कर दिया जाता है।
Q.2 -क्या लेबर कोर्ट/लेबर कमिश्नर ऑफिस में शिकायत लगाने का कोई फीस लगता है?
Ans-नहीं, अभी लेबर कोर्ट/लेबर कमिश्नर ऑफिस में शिकायत लगाने का कोई फ़ीस निर्धारित नहीं है।
Q.3 -क्या हम Labour Court online complaint लगा सकते हैं?
Ans- आपको अपनी शिकायत पहले लेबर कमिश्नर ऑफिस में लगाना होता है। इसके लिए केंद्र सरकार व् कई राज्यों ने ऑनलाइन पोर्टल जारी किया है। जिसके द्वारा आप लेबर कमिश्नर ऑफिस में ऑनलाइन शिकायत कर सकते हैं।

Supreme Court ke 26 Oct 2016 ke order Equal Pay For Equal Worker ke anusar aap daba kar sakte hain. Aise kam se kam minimum wages dene ka pravdhan hai.
Aap bilkul demand kar sakte hai. Agar aap Workman ke definition me aate to Labour Commissioner ke yah aur agar nhi aate to Aap advocate ke though legal notice bhej sakte hai.

Ham employee ko vahan per bevkuf Samjha jata hai Hamari Koi Ijjat Nahin Hai payment fasne ki vajah se a Ham Aage ka decision Nahin Le Pa rahe hain.

Dear sir, i am working as center manager in a gaming zone, due to lockdown the company didnot give the salary they were providing covid fund means if my salary is 35 k they were giving only 5 to 6k they named as covid fund . in the month of april we received the salary of march it was full salary 33k after that they started giving covid fund for the next 2 month after , they started removing the games from the store and they have given the reason of renovation in that time they make me work for 9 to 12 hours daily for the whole month . after that they didnt given a single rupee , not even the half of the salary , now in the month of sept they send me joing mail of .which says that i will have to join the other location store from 1st of nov 2020 i agreed and waited, i have to travell from vadodara to ahmedbad for job , now the problem is that they have send me a layoff letter . in today evening in that it says we are laying u off. now plz guide me howshall i proced they have layoff many staff without information.
If you are a manager, then you are not come under “Workman” definition and layoff (industrial dispute act 1947). So, you should send a legal notice to your employer through a lawyer and file a civil suit in court for challenge your illegal termination.

अभी हाल ही के दिनों में 25 अप्रैल 23 को अज़ीम प्रेमजी फॉउंडेशन ने बेबुनियाद आरोप लगाकर इस्तीफा देंने का दबाव बनाया गया था। लेकिन मैंने इस्तीफा नही दिया है। मैं वर्ष 2O11 से नियमित पद पर उत्कृष्ठ कार्य करता आ रहा था। आखिरकार इन्होंने termination लेटर भेजा है और उस पर हस्ताक्षर कर वापस मंगवाया है। लेकिन मैंने अभी उस पर हास्रताक्षर कर वापस नही भेजाहै।भारत और विश्व भर में अज़ीम प्रेमजी फाउंडेशन के सामाजिक सरोकारी संस्थाओं में बड़ा नाम भी लेकिन आजकल पुराने साथियों को निकालने का यहां दौर प्रारंभ किया है। मुझे आगे की कार्यवाही स्टेट labour कार्यालय में जरूर करवानी होगी।
