Gratuity form for withdrawal: अगर आप किसी ऐसे Private या Government Company में Job करते हैं. जहां 10 या उससे अधिक  Employees काम करते हैं तो आप Gratuity Act के अंतर्गत आते हैं. ऐसे में Company को Join करते वक़्त Employee को Form “F” (उपरोक्त) भर कर दें. जिसमे अपने घर के किसी भी सदस्य को Nominee बनाना होता है. Gratuity Act के Form “F” को यहां क्लीक कर डाउनलोड कर सकते हैं. उसका Format कुछ इस तरह का होगा.

इस Form में अपना Name, Full Address, Department Name & Address जहां आप काम कर रहे थे. इसके साथ Joining Date के बाद सेवा समाप्ति की तिथि और कारण आदि का उल्लेख करना होता है. आप अपना Gratuity कैलकुलेट कर Claim की राशि लिखें. इसके साथ ही अपने Bank Account का Detail दें जिसमे उक्त राशि जमा की जायेगा.

इसके साथ ही कोशिश करें की इस आवेदन के साथ आखिरी Salary Slip, Offer letter की कॉपी, त्यागपत्र देने के तारीख और Gratuity की राशि इत्यादि का ब्यौरा जरूर दें. आवेदन करने के बाद कंपनी को एक महीने का समय जरूर दें.

Labour Ministry ने कर मुक्त ग्रेच्युटी की राशि को 10 लाख से बढाकर 20 लाख कर दिया है. Gratuity से संबंधित उपदान भुगतान (संशोधन) विधेयक 2018 को 21 मार्च को संसद की मंजूरी मिल गई. विधेयक में निजी क्षेत्र और सरकार के अधीन सार्वजनिक उपक्रम या स्वायत्त संगठनों के ऐसे कर्मचारियों के उपदान (ग्रेच्यूटी) की अधिकतम सीमा में वृद्धि का प्रावधान है. यह विधेयक पारित होने के बाद संगठित क्षेत्र के कर्मचारियों को 20 लाख रुपये तक की Gratuity पर टैक्स नहीं देना होगा.

यदि Company घाटे में चल रही हो तो भी उसे Gratuity राशि का भुगतान करना होगा. Payment of Gratuity Act, 1972 के अनुसार, एक कर्मचारी ने यही कंपनी में कम से कम 5 वर्षों तक निरंतर सेवा प्रदान की है तो वह ग्रेच्युटी प्राप्त करने के योग्य है.

किस Condition में Gratuity के लिए 5 वर्ष से पहले भी Claim कर सकते हैं?

यदि किसी Employee की Service को उसकी Death के कारण Terminate  कर दिया गया है या किसी Accident या बीमारी के कारण अक्षम हो गया है, तो Employer को उसके द्वारा या उसके Nominee / कानूनी वारिस को Gratuity का Payment  करने के लिए कानून द्वारा अनिवार्य किया जाता है. इस स्थिति में कर्मचारी के Nominee को उसके जितने Years की Service होगी उसके अनुसार Gratuity दी जाएगी.

अगर Nominee नाबालिग हो तो क्या होगा?

इसके आलावा कानून के अनुसार इस स्थिति में यदि Employee का Nominee नाबालिग है, तो Assist Labour Commissioner, State Bank of India या किसी अन्य Nationalized Bank में अपने नाम पर Fixed Deposited पर पैसा निवेश करेगा. जब वह नाबालिग बालिग हो जायेगा तो उसको वह राशि प्रदान की जाएगी.
